My lawyer ran out of patience with Eblag and presented her findings before a court in Bristol
We had to wait for 7 days for their decision, which was;
Ebay have failed to respond in anything like a 'progressive manner'
Ebay must,with immediate effect, instruct paypal to release the funds in the account
The imformation provided by the vendor was perfectly clear and accurate
The buyer has made no attempt whatsoevrer to remedy the situation, and any further actions on his part are to be persued independantly of Ebay

Here we go !
That little tosser in Swedishland has launched a legal counter claim, the goods sold did not match the description ect.
The scamming little shit in faggotsville and got himself an 'independant' report on the XL motor,stating a FEW faults. the left and right crankcase halves are as mis match ( sold as re built stolen recovered )
The Honda dealer that commisioned the report said it may have been built up from several different motors ( see above )
The little twat has already had legal papers served on my mate that sold it for me.
The little twat does not know that I have reciepts for full gasket set, repaired cyl head, fulll set of rockers, cam chain ect, pretty much proving a rebuilt engine

Im actually effing fuming as Ive just bought chain set and paid a deposit on a years insurance
I foolishly thought a court judgement may finally end this bullshit but

This is going to turn into a complete nightmare.
The XL lump was built up out of two different motors, one leccy start, the other not, I bought a rebuilt head with a small repair to the camshaft journal,new gaskets/seals all round,stainless engine case allen bolts all round,each one with a dab of red gasket compound under every bolt head so it will be easy to see if it has been messed with
I have no doubt that this guy bought the motor with the intention of raping it for parts then wanting a refund
The only way to prove any kind of foul play is for the motor to be returned to the UK to be re examined
The buyer refused to pay return shipping costs before the court judgement so he aint gonna pay now
WTF can I do now, Ebastard have served a summons on my mate,who sold it on my behalf

Did you state this on the description? An engine built using non-paired cases can render it useless. If you didn't mention it, then you may be in the brown sticky stuff.

Ebay are taking the seller to court for selling goods that are not 'as desribed'
There are tons of technical issues here, the motor was sold as rebuilt,NOT running but no reason to believe it wouldnt run.
He claimed the motor was missing an internal component which he provided specific dimensions for (how would you know its missing without dissmantling the motor ?) I dont know what part he's refering to
Why did it take over two months to decide that it is the wrong motor,despite admitting it was bolted up in his frame and a Honda dealer in Meatball land confirmed the motor was correct for that year of XL,as defined by engine number

Let's face it, you wouldn't go to a nurse to get good advice on a problem with a Falco - you'd choose an Engineer or a mechanic...
