Legal Stuff...

Hi all,

I am self-employed, and of late I am sick of people not paying for my work :smt013 Even being called out at night to stop a leak and re-instate the cold into the house and they think because I only did a couple of things, they shouldn't pay :smt011

I know small claims court is there for such situations, but, a guy told me who was a manager of a shop, that anyone can put an entry on someone's credit details held with either equifax or experian. Is this true anyone?

Logically, if large companies can put stuff on there, why can't small companies or business people do the same. Cost is a consideration of course :smt017

Just winds me up, even in this downturn economically, I have my bills to pay as well....

make them sign a contract BEFORE you start work....

and that contract can say all sorts
(ie non payment penalties etc)


Let's face it, you wouldn't go to a nurse to get good advice on a problem with a Falco - you'd choose an Engineer or a mechanic...

The small claims court isn't the full answer though - just because you get a judgement doesn't necessarily mean you'll get your money back, it just means that you have established in law that the debt exists. The money still has to be recovered, and the court bailiffs will only make a couple of attempts to do so and if that fails you need to go further.

You're probably better going to a debt collector than to the court as that's probably where you'll end up going (Mike used to be a private bailiff and often got these jobs).

Hi all,

OK, the chap concerned who owes me money, is a bloody bailliff :smt013 So, I guess no chance of getting my money off him :smt009 Unless I report him to the court maybe....

If he does work through the court system, put a slur on his work.....

Find out which company he works for and give them a ring. His boss might put the arm on him to pay up if he felt the company was going to get some bad press, via the local paper maybe??

Of course that depends upon the type of company he works for. Or you pay someone bigger than him to recover your money (legally of course occifer) Or of course you could employ his company to recover your money.

Now that would be interesting

Personally I'd go via the small claims court, cheap to do and at least you get a judgment against him. (then employ his company to get your money!!)

Are bailiffs allowed to have unpaid debt?

You might want to look into that.

I would think that would be good cause for revocation of the Consumer Credit Licence without which they can't operate.
