Don't believe it's an MOT Fail.
You have to mod the wiring so it will run .... then, yes, you can pull away with the sidestand down or if it's running in neutral on the sidestand and you knock the gear lever into gear (
I've done this when squeezing the bike away in the garage .... fortunately with the sidestand switch operational) then you'll launch the bike.

I'd check out a Honda Blackbird side stand, especially if you have raised ride height. This was discussed a while back:

If you fancy a Fireblade sidestand I have a nearly new one for £35 including postage, but I honestly prefer the Blackbird stand.

My bike recently passed the mot with the s/stand switch cable tied to the oil line as the stud that was welded on to hold the switch in with is no longer welded on,not easy to re weld with no welder.
To bypass the switch simply join all 3 wires together.
I have a Busa stand on mine, needs a lot of fettling to make it fit, NOT the best option
Cleverly disguised as an adult !
