He already had points and driving was essential for his job.

So with it so important that he maintains the ability to drive, he chooses to drive:
  • 1) Without Insurance
    2) Without the correct license for the vehicle he was driving
    3) In a careless manner that resulted in an accident

For which he gets a total in fines of £400 and an additional 12 points on his license .... points that are meaningless as they decide he can continue to drive as it would cause hardship if he couldn't.
.... well, when he was doing those 3 things listed above, one can only assume he didn't think that having the ability to drive taken away would be such a major inconvenience.

Yep, if he'd done something equivalent on a bike, I guess a 6months prison sentence would have been the likely result - given that is what they seem to hand out for going a bit quick these days.

You left out the fact that he failed to appear in court a couple of times!

So, the rules say that he should have a ban. So how the f*ck has he escaped one? Rules are rules, like the law is the law, why should it not apply just because you "need" to drive 2,500 miles a week?

Irrelevant. Your driving license (or lack of the correct one, in this case)is a personal matter. If he loses it, that affects HIS ability to work, not the company's ability to deliver. In the current climate, I'm sure there are plenty of other capable persons with the correct license, and insurance, and basic driving skills, to be "second in command" of the company.
