My insurers solicitor has told me that the northern Scottish police have come back with pages upon pages of documented evidence from forums and blogs about the Falcos sidestand.And are using this as there main reason for not accepting responsibility.
So YES they done a lot of homework on this. I guess HAMISH MCBETH was more realistic than you thought

Can't see how any evidence about the inadequacies of the stand is any get out for them.
Is the stand as officially sold - yes
Have you modified the stand - no
However good or poor the stand you have to make sure that the bike was left in a stable condition - did they do this - obviously not
If you had done a similar thing and parked it by a pavement and it had fallen on a small child and injured them would they say "never mind sir, it's all down to the crap sidestand, you are absolved of all blame associated with how you parked it" NO OF COURSE THEY WOULDN'T .... it would still be your responsibility to make sure that you left it safely.
The stand might be crap but bikes do not fall over every time they are left - just when poorly parked or knocked over somehow.
Fight them on this - speak to a good lawyer / talk to TC (I say this yet again)

Certainly haven't upset me. Genuinely sorry for the situation you find yourself in and hope you get it resolved to your satisfaction. As D-Rider says they are responsible for your property whilst it is in their charge and care and i would fight them all the way.
