I learned the hard way

Some of you on here my remember the difficulties I had with selling an xl600 engine through a mate on eBay about 2 years ago.
It got rather drawn out about the buyer claiming the engine was not as described ect,the buyer lived in Sweden, loads of elaborate excuses from mate involved,so elaborated they seemed plausible.
Well the fucker has ripped me off again,plod tell me my only hope is to persue through small claims court as it is a civil matter.
So, my chances of success? Cost ?
My preferred option would be baseball bat.
I'm fuming that I gave the waster the benefit of the doubt and he sealed the deal by offering to fix my car when I needed it and blagged me for £97

You cock! But, I suppose you already know this. Personally, I'd be over to his gaff and bagging up what I deemed to be worth the money owed and recoup lost funds that way.. If he tries to contact plod and claim you've stolen his property, then it'll be a case of reviewing the situation.. There are always plenty of scallywags around who'll do over a place for a few quid.. Even paying out a little extra to leave the twat with nowt should put a smile back on your face at least. :smt002

Plod seem to say that for most things now. Small claims can be ok depends on his situation and whether he has any assets I think as to whether its worth it. Don't think he can claim costs though whether you win or loose

Doesn't sound like a 'mate' to me, sounds like a deceitful, lying, pathetic excuse for a human being. Not only has he shown zero remorse for the first con, but has worked you over again.

Honestly, for £97 quid it probably isn't worth the hassle of small claims, it would be less stressful to suck it up and move on. Don't trust another word that comes out of his mouth.

I did hear in one such case the aggreived party sprayed battery acid on the car paintwork as it can't be painted over properly apiarently ... Not that I would advocate any such action

Taking it to am extreme I did know a bloke whose sister was left part less by a drunk driver who in turn was left seriously damaged on a later accident ... By coincidence the girls brother was driving ... The drunk got 400£ fine the brother 5 years

People think the small claims court is a way to get your money back - It ISN'T!

All you get is a judgement in your favour - ie the law agrees that they owe you the money. Court bailiffs will then try twice to collect the cash (and usually fail) after which it's up to you to employ a private bailiff to extract the dosh - at your own expense if they are unsuccusful -and you can't get cash out of people who don't have any or are good at hiding it...

Put it down to experience.

As someone who tends to trust people and always give them the benefit of the doubt, I can imagine how you feel about this. I remember reading the original saga with disbelief, so another slap from him must hurt. However, in my opinion, your so-called mate needs to be removed from your life forthwith. I agree with BG; further action will only reap further frustration.

I can empathise with you giving this bloke a 2nd chance, I'd probably do the same.

He'd be close to the top of my "you can get fucked" list now though.

I find a cricket bat is better as it has a few very hard edges......feck that I'd be round his gaff with bat and would be taking my £97 out on anything I could find......I hate fuds like this....

Thanks for your replies.
The amount that this fat bastard has ripped me off for is about £800 as I never saw any of the other XL bike parts back. Then add on the £180 spent on bus fares and whatever it will cost me to get my car recovered.
I went round to his house but he would not come out,maybe I should let myself in.
As for any likely assets,I don't think so.
All of this is not nice to have as your first thought of the day

I can understand the emotional response - I would feel the same. But if the guy doesnt have anything, you cant get anything. And the baseball bat type suggestions are stupid - as someone has pointed out you can end up worse off that way.

Better bide your time. Keep your eyes and ears open until (if ever) he does have something. Then visit.

But above all - learn. "neither a lender nor a borrower be". I never ever lend any money to anyone. Even the kids. Because lending creates problems and unpleasantness even if you get it back. As for thye kids I recognise inevitability - I give it to them instead.
