My first RTA.. and what is wrong with some people!?

I stopped behind two cars at a junction. The one in front was signalling right and turned right. The one behind wasn't signalling and didn't move for several seconds.

I was a little impatient and decided to go round. Then I get a crack in the exhaust as the driver decides at that moment to turn right. I was essentially in front at that point so they obviously didn't look. Anyway.. I didn't come off and it's one for the insurance.

My brother is behind me on another bike.

We stop to exchange details and the two women in the car are hysterical. They don't want to exchange details because I'll just say it's her fault. Rather confusing as the insurance will decide no matter what I say.

They want to call the police. But nobody is hurt?

Next thing a white van pulls up and a large shirtless neanderthal jumps out and starts shouting at us. I can't really remember what. Next thing he goes for me and my brother intervenes. The guy takes my brother down and someone else appears out of nowhere and between them they hand his arse to him on a plate.. (split lip, cut nose and a few other bruises anyway)

I get on to the police as more inbreds are turning up. They take an age to arrive. Meanwhile they're shouting and cursing but as I'm now on to the police they're laying off.

Eventually they turn up. Apparently an independent witness claims we started the fight (probably the second guy who turned up.. certainly not someone independent). So the officer won't do anything.

At least they get the details out of the other party. They also run the details of the white van and shortly after the driver is invited to sit in the back of the patrol car so he's done something dodgy.. alas it won't be as serious as being charged with assault.

It wasn't worth it for a few scratches.

Jeeezus ! What a friggin nightmare !
Hopefully the word of both you and your brother against the knuckle dragger may change plods mind and press assult charges ?
hope this works out for you, and yes WTF is wrong with some people ?

Thanks fatboy. Unfortunately 'they' seemed to multiply at an alarming rate by the time the police turned up and too many witnesses for the contrary - I have a feeling it will be the same for the insurance although I may possibly have been in the wrong (I'm not admitting fault) I would like it to be decided fairly.

Just tell the truth. Don't admit any liability and it will go to 50/50
You did everything right from a legal point of view by exchanging details, the heavies that turned up sound complete knobs.

Thanks. Yes they were.

A couple of lessons learned:
Don't be impatient just because your adrenaline is up after hacking round the countryside.

Don't take your helmet off!

At least you're ok. Is it worth going through the insurance? It sounds like it'll end up being 50/50 and if it is only a few cosmetic injuries to the bike and presumably just a scratch on her car? Why bother putting a claim against yourself. Loosing your no claims and putting your premium next year. I assume you'll also have to declare the claim to your car insurer come renewal time which will more than likely have an effect on that premium too.

As for the local Richard. I'll never understand why people think it might be a good idea to start a fight with a person wearing protective gear and effectively a set of carbon fibre knuckle dusters.

Really sorry to hear this

Even for a no damage / injury incident - I ALWAYS inform the police
(There can be no comeback then)

After that performance there's sod all chance the other driver is going to do anything sensible such as not go through the insurance.

I have virtually nothing to claim for. A couple of scratches on the exhaust and the bracket is bent in a fraction. The only reason I did report it to the insurance is to cover my own arse by complying.

oh

if your brother got the armpits registration plate...... post it everywhere - Facebook, etc

just say the owner assaulted a biker - generally word gets around....
