I am not dsagreeing with the rights and wrongs of the case quoted, all I have tried to do is give an explanation to those of you (and I appreciate that some of you do have an unerstanding) who have never been involved in the legal process of how the system works.
I can cite many examples where I was prepared to go to court and give a case a run for its money. At least at the end of the day, if they were aquitted by a jury, then fair play, but all too often the CPS would go for a plea bargain at an early stage in the proceedings, cop a plea to a section 3 and the scrote would leave court with a massive grin on their face.
Back in the day when I first joined the job, the Police decided themselves what cases would be prosecuted, the final decision lying with the Chief Inspector who was responsible for overseeing all cases. Then they brought in the CPS to replace the prosecutions department and things went downhill very quickly.
CPS often run shy of making the big decisons, which is why as mentioned, it is not so much the judicial system per se that is broken, but the CPS element.
It is better to arrive 30 seconds late in this world than 30 years early in the next
