any help

i went on a holiday with the campervan , to south uist - barra - tiree but in the ferry the guys loaded a lorry and scratched the van , unkown to them i was watchin above deck and could not do anything about it , i did report it to the chief officer who cam down and looked at the damage but said he wasint or would not admit responsibily , , strange ? but i did not tell him i took pictures , any advice would be appreciated

I'd be more inclined to go to the truck company with a claim. Their guy was driving it, regardless of being guided by a ferryman. His culpability, surely? If im driving my truck and trailer at work, if it aint gonna fit I'll stop and argue the toss before hitting someone else's vehicle. Funnily enough like I did on the ferry to Islay when they tried to shoehorn my 4 tonner and trailer between a truck and a rather nice BMW.

A note of explanation to our Kiwi members ...... despite the picture on the top of the cab, that vehicle is NOT a mobile house of pleasure.

Joe - hope you get it sorted - I think Kwackerz is right - the truck driver is always responsible if he's driving.

There may be an issue of joint liability, the loading officers who were not paying attention, and the driver of the truck for failing to pay attention as to how close he was to your vehicle.

Proceedings would be issued against both the truck operator and the shipping company and it would be for them to decide who was going to accept liability and if they fail to do so, then issue proceedings and let the courts decide.

I doubt whether a law firm would take this on as they would not be able to recover their costs, but Citizens Advice often have lawyers who have open surgeries and would be able to advise free of charge, and tell you who the letter of claim should be sent to and how to word it and CAB or the courts would be able to help you complete the paperwork depending on the response.
