smoking ban

My employers are trying to enforce a ban on smoking 'whilst on duty',smoking permitted only in designated areas.
There are no designated smoking areas when I'm out on a recycling round so that means no smoking until I return to the yard,which could be 5,6 or even 9 hours.....
Civil liberties issue ?
About 85% of us smoke,yes I know that makes 85% of us stupid !

Sorry - got to agree with Jay.

Look on it as your employer doing you a favour - both for your health and your wallet.

That said, under the working time directive you are entitled to a number of breaks during the day in which you will not be on duty so as long as you aren't in a company vehicle or in premises to which the ban applies, I guess you can have a ciggy if you really must.

Use a vape thing? Probably cleaner than smoking anyway.

Although those are starting to get banned too, thankfully. Nothing like trying not to snack all day while at a desk all day while a person next to you is breathing chocolate flavoured vapor at you!

Funny old issue this. I once stopped smoking in the offices and provided a smoking room. Not only were the large majority in favour of this ( including the smokers) but they raised a petition to have the smoking room closed. Only problem was the very few smokers who did so outside the front door littering the entrance steps with fag buts.

The shop floor attitude was entirely different. This was before the legislation came in so I didnt even try to stop them killing themselves. Never fight unnecessary battles.

I dont know the precise detail of the law but I dont believe your employers can allow you to smoke in their buildings or vehicles, but they would be silly to try and stop you doing so out in the open air and when they have no realistic way of monitoring you. They would be making an unnecessary problem for themselves.

Is it an LA employer. "Human resources" dept staffed by - well the sort of people that go into HR?

Yes, Lazarus, it is a funny issue.
H.M. Prison Services recently came unstuck after trying to enforce a total smoking ban.
As a smoker I hated smoking cars on trains, hate smoking rooms because they stink.
I cannot see the problem of smoking outdoors, even when I'm outdoors I will not smoke near kids/families, I walk away if they come near me, I dont smoke in front of my mates kids
